In Texas, domestic violence is legally called “assault family violence.” The most common level of this offense is a Class A misdemeanor punishable by up to a year in prison and/or a fine of up to $4,000. In most cases, the court also issues a temporary restraining order that prohibits any type of contact with the alleged victim until the case has been fully resolved. Where serious bodily injury has occurred, the charge will likely become a felony with a lengthier prison sentence and stiffer fines.

What are the Penalties for Domestic Violence in Texas?

In the state of Texas, the possible penalties for domestic violence include:

  • Class A misdemeanor – A $4,000 fine and / or up to one year in jail
  • Third-degree felony – A $10,000 fine and 2 to 10 years in prison
  • Second-degree felony – A $10,000 fine and 2 to 20 years in prison
  • First-degree felony – A $10,000 fine and 5 to 99 years in prison

In addition to the above penalties, restitution may have to be paid to the victim if you are convicted of simple assault. Restitution can include replacement of damaged property, counseling, or medical treatment.
